New regulation of fines and their link with the provincial inspection

Interview with Osvaldo Rivalta Torres, director of Provincial Inspection.

As a result of the resolution fifty of the Governor of Havana of March 13, 2022, the regulation of hygiene and adornment of communal and urban services in Havana is launched. This empowers each of the state inspection directorates, the transportation directorate and the health inspection directorates to apply what is established.

This resolution puts into force and makes it very clear what are the prohibitions that this regulation has so that each one of the inhabitants of the capital puts it into practice, taking into account what is related to decoration, hygiene, urban communal services, green, the ambience of the city and the control of buildings and land use, the cleaning of the city and the obituary services for the entire people of Havana.

As part of this regulation and as a result of a group of measures that are being adopted in the capital due to the unfavorable situation that we have today with communal hygiene, resolution 87 is put into force, which today approves taking a group of measures on the subject of the regulation for the decoration, the hygiene of communal services in terms of personal violations that brings some novel aspects that were previously in decree 271/2001.

Now this resolution 87 that empowers the governor to apply violations in order to increase the level of value of the amounts of the fines, in it there are very important aspects that the inhabitants of the capital should know, such as the hours of dumping garbage, etc.

Why is this decree put into force in the current context?

To also seek economic order, due to the need to mobilize the popular consciousness of each one of the officials and directors of the capital in terms of the people, also for beauty, sanitation. People should know that whoever moves or affects any medium, the deposits of home collection will be penalized with a fine of one thousand five hundred to two thousand pesos and the obligation to compensate for the damage caused. That is to say that by no means can any citizen be taking from the collective deposits intended for garbage collection, nor mistreat them, nor break them, nor remove the wheel to use it for other purposes.

Whoever fails to comply with this will be fined. It is also valid to emphasize that the population knows that whoever throws household waste outside the established hours will be notified with an amount of five hundred to one thousand pesos. It is being sought that each one of the residents of the capital take out the garbage at the time that is included so that communal after ten at night can carry out their work, and keep the city clean for when it dawns.

Any person who runs the container of the place, without the authorization of the heads of the communal areas or the company that is authorized for this, will also be notified with this same amount. It also carries an amount of one thousand five hundred to two thousand pesos who, in these deposits that are intended for home collection, pour debris, wood, metal or inappropriate objects into it, since what this does is mistreat the container.

Likewise, this fine will be imposed on all the colleagues who, due to the productions, whether they are from the shops, from the services they provide of gastronomy, pour their boxes, their cardboard that are not authorized for that.

It is good to highlight the issue of rubble to the population. Contracts can be made for the dumping of rubble, the law makes it clear that whoever fails to comply with this, who keeps rubble or construction materials or remains of pruning, objects in disuse, whether on public roads, on lots, or in public spaces will be notified with an amount of five thousand to six thousand five hundred pesos.

Subsection Ñ highlights that whoever fails to comply with the issue of not extracting solid waste and garbage collection on public roads, whoever dumps garbage on public roads without proper authorization, will be notified with three hundred and fifty pesos and the obligation to refrain from continuing such conduct.

There is something relevant in this decree that was not put into force before, which is that all legal or natural persons that are detected in their state vehicles dumping solid waste on public roads will be fined between one thousand five hundred and two thousand pesos and The state media will take care of him for six months and he is put in provision of the service of the communal management.

Another measure that must be given the utmost importance in this, which is also for legal entities, which are all those who at a given moment have all the permits established to cut the road and have to put up their signs as established and do not comply with this indication, they will be notified with one thousand five hundred to two thousand five hundred pesos. This is a measure that must be put into practice because we know that there are many entities that, with the desire to solve a social problem, well, fail to comply with everything that is established, cut the road and then do not take it to its original state.

In this resolution 87, subsection Z explains that all legal entities for breach of their functions that prevent or hinder the existence of a clean, hygienic or health environment can be subject to a fine of one thousand five hundred pesos. This is clear that it is for the colleagues who have the responsibility in the municipal direction of community services to collect the garbage in a timely manner as established, when they fail to collect or extract this solid waste they will be notified with a fine of five A thousand pesos.

This norm this norm is put in place as of June 20, 2022. Today we are giving all the preparation to each one of the inspectors of the capital so that they apply all these norms and so that the population also knows them.
