The Law of Criminal Execution, which is the result of the integration of regulations, laws and normative, concentrates in a single body of law the regulations related to the excitation phase of sanctions and safety measures, in order to achieve a better performance, location and use by the law operators´ hands. 

This draft of law, debated by prosecutors, instructors, officers of the Ministry of Homeland, teachers of the Havana´s University, students of the Law Faculty and deputy directors of the law system, seeks to eliminate the law dispersion existent in the country.

The initiative introduces 7 new proposals that provide answers to the lacks diagnosed in issues such as criminal sanctions, safety measures, pre-trial preventive detention measures and the conditional dismissal.

The Criminal Execution Law is designed, in a harmonic way, with the regulations proposed of the Penal Code and the Law of the Criminal Process.

Among the issues requiring for a solution, associated to rights and essential guarantees for the people, during the elaboration process, it was identified the need for the prevention of a special treatment to a group of sentenced individuals due to special conditions such as: the existence of disabilities and serious illness, being a minor or under 18 years of age, among others.

With the approval of the Constitution of the Republic on 2019, a group of guarantees were countersigned in the articles 60,94,95 and 151, which require a further normative development because they provide the obligation to comply with judgments and the rest of the steady regulations of the courts of law.

Furthermore, it is defined the State´s responsibility in favor of the inmate´s re-insertion in the society and those who pay non-custodial criminal penalties or face a different penalty of measure taken by a court of law.

So that, the respect for the rights of those people facing a criminal process, is intended to be guaranteed by the identification of 68 constitutional precepts which transcend the norm they represent.
